Terms of Service

Last updated: 12 June 2026 | Version 1.2

These terms govern your use of MarketSnipe. By signing up, you agree to them. We've tried to write them in plain English. The legal substance is the same as a corporate version, just less painful to read.

Quick summary: We provide a tool that monitors Facebook Marketplace listings for you and sends app inbox alerts and optional device notifications when listings match your criteria. You can pay monthly or annually if you continue after the trial. You're responsible for what you do with the alerts. We're an Australian-registered business, and the Australian Consumer Law applies.

1. Who we are

MarketSnipe is the registered business name of Jonathan Palacio trading as MarketSnipe (ABN 75 692 080 724), an individual/sole trader registered in Australia. Our main business location is Queensland 4064, Australia. References to "we," "us," and "our" mean Jonathan Palacio trading as MarketSnipe. References to "you" and "your" mean the person or entity using the service.

2. The service

MarketSnipe monitors selected publicly visible listings on Facebook Marketplace on a recurring basis and sends alerts to your MarketSnipe inbox. If you enable device notifications, we may also send push notifications for new matches. MarketSnipe is an information and alerting tool only. We do not buy, sell, list, inspect, authenticate, reserve, negotiate for, or transact in any item on your behalf.

Under Australian Consumer Law, you have rights that cannot be excluded:

Beyond these statutory rights, our policy is:

7. Acceptable use

You agree not to:

8. Third-party platforms

MarketSnipe monitors selected publicly visible listings on Facebook Marketplace. We are not affiliated with, endorsed by, or sponsored by Meta Platforms Inc. or Facebook.

We don't require your Facebook login. We don't post on your behalf. We don't message sellers automatically.

Access to third-party marketplaces can change without notice. We may pause, limit, or disable scanning if a platform changes its access rules, technical systems, or availability, or if continued scanning creates security, legal, account, or operational risk.

Your interactions with sellers, your purchase decisions, and any disputes that arise are entirely between you and the other party. MarketSnipe is a discovery tool — we surface listings, you decide what to do with them.

9. Automated matching is a guide, not a guarantee

MarketSnipe uses automated checks to estimate whether a listing is a good match for your alert criteria. This is a guide, not a guarantee:

10. Service availability

We aim to provide a reliable service, but we do not guarantee uninterrupted scanning, alerts, or availability. The service may be unavailable or degraded for:

11. Liability

Our total liability to you, for anything related to the service, is capped at the amount you paid us in the 12 months prior to the claim. This cap doesn't apply where excluded by Australian Consumer Law.

We're not liable for indirect or consequential losses (lost profits, missed opportunities, etc.) arising from the service.

12. Intellectual property

The MarketSnipe service, including its code, design, alert logic and internal systems, is our intellectual property. You get a non-exclusive, non-transferable licence to use it while you're a paying customer (or trialling).

The data you put into the service (your alerts, your settings) belongs to you. We process it to provide the service, that's all.

13. Termination

You can cancel any time from the billing portal. Your access ends at the end of your current period.

We can terminate accounts with notice for breach of these terms. We can terminate immediately and without notice for serious breaches (fraud, illegal activity, abuse of other users or our staff).

14. Changes to these terms

We may update these terms. Material changes will be emailed to you with at least 14 days' notice. Continued use after the notice period means you accept the new terms.

15. Governing law

These terms are governed by the laws of Queensland, Australia and applicable Commonwealth laws. Disputes will be heard in Australian courts.
